Cerebrovascular Accident (CVA) Criteria When Filing for Social Security Disability

When someone has a cerebrovascular accident (CVA) or stroke, the blood flow to part of the brain is unexpectedly at a standstill and oxygen to the brain is restricted. Once oxygen to the brain is depleted then part of the brain can potentially be killed off and this contributes to certain bodily functions controlled by that affected part severely being impacted. Some of the residual effects of a stroke s/p episode can be:

  • Impaired speech
  • Cognitive or memory loss
  • Vision loss
  • Difficulties upper or lower extremities
  • Restricted gait or walking
  • Balance and dizziness

The first thing an applicant for SSDI or SSI needs to be aware of regarding a recent diagnosis of CVA or stroke, is the Social Security disability 3-month medical deferment requirement s/p diagnosis. According to DI 25505.035, a medical deferment involving the duration requirement is unavoidable when the necessity for future medical evidence is needed to assess the duration of disability. Social Security characterize a CVA, as a major event followed by a period of stabilization and varying degrees of improvement. At least 3 months after the event is necessary to assess the medical severity and duration of the condition signs and symptoms.

Social Security Medical Listing 11.04 Vascular Insult to The Brain

SSA will evaluate a CVA and the evidence of residual impairments 3 month following diagnosis and the following criteria must be met in order to meet or equal this medical listing:

A.Evidence indicates sensory or motor aphasia resulting in ineffective speech
B.Ineffectiveness of motor function in the two extremities with the:

  • inability to stand up from a seated position
  • balance while standing or walking
  • decreased usage in the upper extremities

C. Marked limitation in the physical functioning in one of the following areas of mental function:

  • understanding and remembering
  • interaction amongst others
  • concentration
  • adapting or managing oneself
